WASHINGTON (AP) ? President Barack Obama is asking Americans to mark the 11th anniversary of the Sept. 11 attacks by remembering how far the nation has come since that day.

In his weekly radio and Internet address, Obama is asking people to remember the victims and their families, and to honor the first-responders who risked their lives to help.

Obama says America has come back stronger and al-Qaida is on the path to defeat.

In the Republican address, Sen. John Barrasso (buh-RAS'-oh) of Wyoming criticized Obama's presidency and said the nation isn't better off than it was four years ago under President George W. Bush.

Man arrested for DWI after driving into church

LONGVIEW, TX (KLTV)- An East Texas man is arrested on DWI charges after crashing into a Longview church early Friday.

Officials say it happened around 3:00 a.m. as the driver went off the roadway at Pine Tree Road and Tenneyville Road in Longview.

Police say the driver struck the south corner of the Greggton Missionary Baptist Church, shearing off a gas line in the process.

The intersection was closed for a short period while the gas was shut off. The driver was arrested for DWI, but has not been formally arraigned.

The Specialist IT Disaster Recovery will ensure that Peabody Energy?s data, data systems, applications and networks are recoverable in the event of a disaster.? In order to recover the Technology capabilities that Peabody Energy relies on heavily in a timely manner, the correct recovery solutions and processes need to be designed, documented, implemented and routinely tested.? Peabody mining operations have become heavily reliant on technology to operate the mine sites and with the addition of the Operations Technology Center (OTC) program, this reliance will significantly increase.? The Specialist IT Disaster Recovery will work collaboratively with the business and IT personnel to design and implement a successful recovery plan that delivers the technology capabilities needed to return the company to normal operations quickly after a disaster.

Principal Accountabilities:

The primary goal of this position is to work with the business and Information Technology groups to design, implement and test a disaster recovery plan/program that minimizes downtime in the event of a disaster. This position is accountable for all aspects of the disaster recovery program and will work collaboratively with the IT Architecture, engineering and implementation groups to develop the recovery solution that meets the growing needs of the business. The Specialist IT Disaster Recovery is responsible for ensuring that, in the event of a disaster, the Peabody employee and client base experiences minimal disruption.

This position will:


  • Serve as the owner of the BC/DR program delivering cost effective recovery solutions.?
  • Responsible for coordinating and execution of regular audits and tests of the BC/DR plans.?
  • Design and implement disaster recovery and business continuity procedures for re-establishing servers, databases, networks, systems and applications in the event of a disruption/disaster.?
  • Perform and analyze disaster simulations for the prompt restoration of services.?
  • Mature the BC/DR practices at Peabody relating to the Information Technology areas?
  • Define and implement a Business Impact Analysis (BIA) rating and assessment methodology and apply it to all of the technology applications and systems.?
  • Work closely with key stakeholders in the business to identify and document their recovery requirements.?
  • Work collaboratively with the information technology groups to develop the design and implement the needed hardware and software solutions that quickly deliver the required business capabilities in the event of a disaster.?
  • Develop specific disaster recovery test criteria, methods and procedures.?
  • Responsible for scheduling, coordinating and reviewing all data recovery simulations to assure that the existing plan will result in minimal or no business interruption.?
  • Coordinate and manage the activities of various groups with recovery related vendors (alternate site, off-site storage and other service providers) in the event of an actual declared disaster.?
  • Perform periodic reviews with third party vendors on procedures and contracted services. Coordinate with vendors any changes needed to existing hardware and software to bring up the technology capabilities to the disaster recovery standards that have established.?
  • Business Continuity: Analyze business needs and work with the various technology groups to develop strategies to improve business continuity. Maintain up-to-date business continuity risk related manuals and standards and develop ones where they do not exist.?
  • Assess the Business Continuity implications of proposed technological or organizational changes, and coordinating any revisions to existing Business Continuity plans or procedures necessitated by such changes.

Job Requirements:

  • BA/BS in Computer Science, related technical discipline, or equivalent experience.?
  • 5-10 years of experience developing, implementing and testing BC/DR plans and has effectively developed a program relating to these capabilities delivering long term operational success?
  • Proven ability and track record developing and driving standards that align to industry best practices relating to business continuity and disaster recovery?
  • Serve as the conduit between the business and the IT organization ensuring that the technology recovery plan delivers the needed capabilities to the business in a timely manner in the event of a disaster.?
  • Knowledge of technology solutions that enable reliable and timely recovery of computer systems, networks and applications including:?


    • Disk replication technologies ?

    • High availability solutions ?

    • Automated recovery solutions ?
  • Strong written, verbal and presentation skills are required.?
  • Able to develop a strong business case/value proposition relating to BC/DR solutions that return the business quickly to normal operations.?
  • Must demonstrate experience in the techniques used to build highly scalable, economically feasible recovery solutions and processes.?
  • Innovative thinker with strong analysis, design and communication skills.?
  • Travel as necessary.

Trust is essential to building enduring connections with employees, suppliers, customers, and the communities in which we do business. And it drives the risk-taking that leads to innovation and progress.

But how do you gain it? It doesn?t hurt to be honest and ethical. What most business owners don?t get, though, is that the best way to build trust is to extend it to others. I often think of a Philadelphia cafe owner who decided, years back, to let customers make their own change from coins he left out on the counter. He was able to serve them faster, yes, but he also won loyal customers and left his competitors behind.

Netflix (NFLX) trusts its employees to take whatever vacation they feel they need. Rock band Radiohead released an album online, trusting fans to decide how
much to pay, and generated more revenue than all its previous releases. The University of
Michigan Health System encourages doctors to apologize when they make mistakes, trusting patients to forgive them?and risking legal liability. The number of malpractice suits has dwindled, and other providers are adopting this approach.

My company, FYI, has moved in this direction (and counseled our clients to do the same). One way that we?ve extended trust has to do with how we approach client engagements and the hours of contracted consulting services.? We want our clients to feel that we are easily accessible to them with no ?stop watch? in hand (as lawyers and many consulting firms do).? We want our clients to feel that we have exceeded their expectations without ?nickel and diming? them with overage costs.? Instead of tightening contract oversight, we did away with it.? There?s a trust payoff, of course, and we spend more time to do our jobs. ?As a result, we have deeper ties to our customers, a number of who have asked for help in building trust in their companies.

(AP) ? Michelle Obama is getting to be a regular on David Letterman's "Late Show."

The first lady delivered Letterman's Top 10 list on Wednesday's show, a night after her speech before the Democratic National Convention in Charlotte, N.C. It was a week after her last appearance on the CBS show, her fourth time this year.

Obama presented the "Top Ten Reasons to Watch the Democratic National Convention."

No. 6: "As a healthy alternative, we're using low-fat confetti."

No. 4: "There will be no Kiss Cam."

And the No. 1 reason to watch the convention, according to the first lady, "At long last, I'll reveal who I'm voting for."

The Sixth Circuit provides the first definitive, court of appeals decision on a recurring issue: is it a fiduciary act, subject to ERISA ? 404(a)(1), for a plan?fiduciary to incorporate (in this case, allegedly untruthful) SEC filings by reference in a Summary Plan Description, thus potentially misleading participants about the risk of investing retirement money in the employer's stock fund.

Dudenhoefer v. Fifth Third Bancorp, No. 11-3012 (6th Cir. Sept. 5, 2012): As the panel summarizes, the plaintiffs (for themselves and a proposed class) "alleged that plan fiduciaries continued to invest in and hold Fifth Third Stock despite its precipitous decline in value in breach of their fiduciary duties including their duty to prudently and loyally manage the plan's investment in company securities."

According to the complaint, the employer's retirement plan provided various alternative investment vehicles, including a fund entirely devoted to Fifth Third stock, as well as nineteen other funds. The?employer also matched contributions 100% up to 4% of the plan partcipants' compensation, but did so entirely in Fifth Third Stock Fund, which could then be moved to the other investment options. Notwithstanding the apparent flexibility, the plan grew steadily more invested in Fifth Third Stock. The Summary Plan Description (SPD) directed participants to review Fifth Third's filings with the SEC for further information.

During 2007-09, Fifth Third stock took a long dive, losing 74% of its value, so participants that were heavily in Fifth Third stock allegedly took a huge beating. The complaint alleged, among other things,?that the plan fiduciaries were imprudent in continuing to offer the Fifth Third Stock Fund as an alternative and that they failed to provide accurate and complete information about the risks in Fifth Third's SEC filings.

The district court dismissed the case at the complaint stage, holding that the Plan fiduciaries?- which qualified as an employee stock ownership plan (ESOP) - were accorded a presumption (dubbed the "Kuper presumption") that investment in company stock is reasonable. The district court also held that the SPD's recital of the SEC documents was not a fiduciary act, because the company and its agent were not acting in a fiduciary duty when they drafted the 10-Ks and other such filings.

The Sixth Circuit reverses. It holds that the district court prematurely dismissed the case at the complaint stage, without allowing the plaintiffs?an opportunity to?conduct discovery.

One legal issue presented in the case was, in fact,?resolved by an intervening Sixth Circuit decision, Pfeil v. State Street Bank & Trust Co.,?671 F.3d 585, 591 (6th Cir. 2012), which held that the?Kuper presumption did not apply to dismissal of a complaint?at the pleadings stage - that the presumption was only meaningful at?a latter stage of the case, summary judgment, when all of the facts are developed. Because the district court resolved the issue without a factual record, the Sixth Circuit remands the case?to the district court.

The second issue, that has not previously been decided in any published appellate?ERISA decision, is whether the plan fiduciaries' decision to?cite to the (possible misleading) SEC filings?in the SPD was a "fiduciary act" subject to ERISA liability. The plan's argument was that because the drafting of SEC filings?is not itself?conducted in a "fiduciary capacity," for the SPD to merely identify them?as a source of information for plan participants is likewise not a fiduciary act. Indeed, "Plaintiffs concede that the preparation, signing, and filing of SEC documents are not fiduciary acts under ERISA."

The Sixth Circuit holds that plan fiduciaries can be held liable for incorporating untruthful government filings into an SPD, as a violation of the duty to provide complete and accurate information about the plan:

"The Amended Complaint plausibly alleges Defendants breached their fiduciary duties by intentionally incorporating Fifth Third's SEC filings into the Plan's SPD and thereby conveying misleading information to Plan participants. ERISA requires the issuance of an SPD, but does not require the incorporation of a company's SEC filings into the SPD. See 29 U.S.C. ? 1022. Defendants exercised discretion in choosing to incorporate the filings into the Plan's SPD as a direct source of information for Plan participants about the financial health of Fifth Third and the value of its stock, an investment option in the Plan."

For the time being, then, at least until plan fiduciaries get wise and cease the practice of blindly incorporating SEC filings into SPD, there are probably many plans vulnerable to the same argument, as this is not an uncommon pratice.
