Capital News ? Woman accused of NYC subway hate crime murder

NEW YORK, Dec 30 ? A 31-year-old New York woman was scheduled to appear before a judge Sunday after being charged with murder as a hate crime for shoving a Hindu man to his death in front of an oncoming subway train.

Erika Menendez of the Bronx borough was motivated by hatred of Muslims and Hindus, according to the Queens District Attorney?s Office.

?I pushed a Muslim off the train tracks because I hate Hindus and Muslims. Ever since 2001 when they put down the twin towers, I?ve been beating them up,? she told police.

Menendez, who is awaiting arraignment in Queens Criminal Court, faces from 25 years to life in prison if convicted.

The victim, 46-year-old Sunando Sen, was born in India and raised Hindu, a roommate told The New York Times.

The incident took place late Thursday at a station on the number 7 line in Queens.

Menendez ? who was speaking to herself as she paced along the platform, according to witnesses ? pushed the man as the train was pulling into the station. He apparently had his back to Menendez and did not see her.

Police released surveillance camera video footage via Twitter showing a woman running from the scene.

?The defendant is accused of committing what is every subway commuter?s worst nightmare ? being suddenly and senselessly pushed into the path of an oncoming train,? Queens District Attorney Richard Brown said in a statement.

?The victim was allegedly shoved from behind and had no chance to defend himself. Beyond that, the hateful remarks allegedly made by the defendant and which precipitated the defendant?s actions can never be tolerated by a civilized society.?

Sen?s death was eerily similar to that of a 58-year-old man killed on December 3 when he was pushed onto the tracks during a fight with a deranged man at a Manhattan subway station. The assailant, later identified as 30-year-old Naeem Davis, has been charged with murder. Davis is homeless.

A New York Post front page picture of the man on the tracks a split second before he was killed by the oncoming train provoked public fury as to why no one helped him ? and why the tabloid newspaper published the photo.

Several million people use the New York City subway system every day, but incidents of this kind are rare.

Before the December 3 death, the last time someone was pushed onto the rails and hit by a train was in 2010. The woman survived.

Thursday night?s incident appeared to have scared many New York subway riders as they kept closer to the walls as trains rolled into the station.

?It?s horrible,? said 46-year-old city resident Elena Rodriguez. ?We?re feeling so insecure now to be in the subway.?

Funded Proposal - Attraction Marketing | meetdorishullett.com

Funded Proposal ? Attraction Marketing

Funded proposal, what it is, and how it can help the home based business, network marketer, or mlm.?

Funded Proposal System

Funded Proposal System ? Attraction Marketing

Here?s a Fast Look at a Funded Proposal Plan, or concept, and how it works:

?

Funded Proposal Plan? The funded proposal is essentially a marketing plan in which you sell an inexpensive value-driven information product to your target market.? Trying to get the money together for any business is a challenge, but don?t forget the other important component of business, which is promoting and advertising your business!

?

Setting up a business is very often the simplest part; marketing a business can be much more pricey and challenging.? Marketing funding can easily be overcome by adopting the funded proposal concept.

?

The whole idea behind marketing is to promote your business, attract potential customers, and convert those leads into sales.

?

Sometimes the lengthy process of getting your entire business system in place can cause you to run out of funds during its process.? Most companies run out of money before they see profit.

?

?Advantages of the Funded Proposal

?

The idea of a funded proposal is one where the business owner or consultant signs up as many potential targeted clients as they can, and takes them through a educational training program which will them in their business, and set up their company.? This is especially of interest to network marketers, multilevel marketing (mlm), alternative franchise, and small home based business owners.

?

By charging the small fee you get the leverage to continue to train as much as possible, without the requirement of spending your own capital especially when you are not too sure what the future holds financially.

?

This serves two purposes:

  1. You gather highly targeted and qualified leads or customers.
  2. You make an immediate sale and income that instantly funds your marketing costs.

?

Funded Proposal and Its Potential

You could potentially stand to gain if you do this properly.?? You have no idea if the new sign ups in a home business, network marketing company or mlm will make any sales within a 3 month to one year time frame.? If for some reason your activities come to a halt, you don?t have to depend on sales volume to stay in business.? The money these new recruits pay for training will help your current cash flow now, as you continue to build your business for future prospects.

?

Funded proposal systems have demonstrated to be an excellent and very successful technique of funding a business as it grows. Nevertheless it is very important to be certain you don?t charge excessively for training, as this may turn away potential new sign ups and jeopardize your efforts.

?

However, by purchasing your valued and inexpensive information product on the front end, your targeted market has qualified themselves to be potential customers of a high-end product on the back-end.? It?s vital to offer superb product information, education, and training to make this option work in the start-up stages.

?

The customers that can grasp the opportunity that your training offers them will quite often grow to becoming excellent marketing consultants with good sales statistics that sustain your business, and that is the reason why funded proposals are such a good idea.

.

Are you looking for an excellent funded proposal for your business and would like to go through the process of finding out how it works?? Continue reading below this post to find out more?

Michigan State edges TCU 17-16 in BWW Bowl

TEMPE, Ariz. (AP) ? Michigan State labored on offense throughout the first half, unable to get anything going on the ground, in the air, anywhere.

For a team that had lost five games by a combined 13 points during the regular season, it was starting to feel familiar.

The Spartans changed their luck by turning to brutally effective running back Le'Veon Bell in the second half, setting up Dan Conroy for another game-winning kick in a bowl game.

Bell ran for 145 yards and a fourth-quarter touchdown, Conroy kicked a 47-yard field goal with 1:01 left and Michigan State rallied to beat Texas Christian 17-16 in the Buffalo Wild Wings Bowl on Saturday night.

"With so many close games and losing like we did during the season, to have one go our way was definitely sweet," Conroy said.

It wasn't always pretty for the Spartans.

Michigan State (7-6) managed 76 yards of offense during the first two quarters as TCU bottled up Bell.

The 237-pound junior started to wear down the Horned Frogs in the second half, grinding out 107 of his yards on a 32-carry night.

Behind Bell, the Spartans went on the longest drive in their bowl history in the third quarter, marching 90 yards to set up freshman Connor Cook's 15-yard touchdown pass to Aaron Burbridge.

Michigan State then recovered a muffed punt by TCU's Skye Dawson at the 4-yard line midway through the fourth and Bell scored two plays later by racing around left end for a 14-13 lead.

TCU (7-6) still had a little life after blowing a 13-point halftime lead, moving just far enough to set up Jaden Oberkrom for the longest field goal in the bowl's history, a 53-yarder that put the Horned Frogs up 16-14 with 2:42 left.

They just left Michigan State too much time.

Starting at their own 25-yard line, the Spartans moved 45 yards in eight plays, setting up Conroy for his second game-winner in a bowl after beating Georgia with a 28-yarder in the third overtime of the 2012 Outback Bowl.

Michigan State's defense held after that, sending the Spartans to their second straight bowl win after three consecutive losses.

"There was no doubt in my mind that after so many losses in similar fashion that we were going to come out on top in this one," Spartans linebacker Max Bullough said.

The Horned Frogs shut down Michigan State's offense in the first half and did just enough when they had the ball to put together three scoring drives.

In the second half, TCU couldn't get anything going against the Spartans' defense ? 84 total yards ? and its defense gave up the long scoring drive in the third quarter, along with the game-winner in the fourth.

Trevone Boykin threw for 201 yards and an interception on 13-of-29 passing for the Horned Frogs.

"A little bit empty feeling inside because we felt like we left a lot on the field," TCU coach Gary Patterson said.

TCU and Michigan State came to the desert with an awful lot of similarities.

The Horned Frogs opened their first season in the Big 12 with four straight wins before losing four of their final six games. Michigan State started 4-2, then lost four of six down the stretch.

Michigan State had the nation's fourth-best defense and was 10th in scoring defense during the regular season. TCU was 18th in total defense and 10th against the run.

Michigan State quarterback Andrew Maxwell was up-and-down in his first season as Kirk Cousins' replacement, throwing 13 touchdown passes and nine interceptions. Boykin took over after four games for Casey Pachall, who was suspended and later left the team, and threw for 15 touchdowns and nine interceptions.

The biggest difference between the teams was Bell.

He ranked third nationally with 137.3 yards rushing per game and had 1,648 on the season, second-most in Michigan State history and 242 fewer than TCU had as a team.

Early on, the Horned Frogs gave him nowhere to go.

Filling holes inside and stringing plays out toward the sidelines, TCU stuffed the bruising Bell on nearly every touch, holding him to 38 yards on 11 carries in the first half.

Of course, it didn't seem to matter what Michigan State did. The Spartans had 29 yards on 12 plays in the first quarter and weren't a whole lot better in the second, with Maxwell throwing two near-interceptions on consecutive passes and an ill-advised trick play that probably should have resulted in a turnover, too.

The Spartans still seemed to be stuck in the ruts in the third quarter before grinding out a 14-play scoring drive led by Cook, who replaced Maxwell for the second time in the game. They had their biggest play on a floating pass from Bell to fullback TyQuan Hammock (29 yards), then Cook threw his first career touchdown pass, a 15-yarder to Burbridge on a crossing route that cut TCU's lead to 13-7.

"I thought Connor did a good job on the 90-yard drive, gave us a little momentum," Spartans coach Mark Dantonio said.

TCU didn't exactly have its way with Michigan State's defense in the first half and missed some chances to build a bigger lead.

The Frogs started gashing the Spartans for decent-sized chunks with their option midway through the first quarter, setting up Matthew Tucker's 4-yard touchdown on an end-around.

Boykin had an impressive off-the-back-foot throw to freshman Kolby Listenbee for 59 yards on the last play of the first quarter and nearly had a 19-yard touchdown pass to open the second, but LaDarius Brown was bumped and dropped the ball in the end zone. Oberkrom followed with a 47-yard field goal and added another from 31 yards after Boykin hit Josh Boyce on a 61-yard pass to put TCU up 13-0 at halftime.

The Frogs couldn't keep it up in the second half.

With Michigan State clogging the running lanes and chasing Boykin around, TCU had 30 yards of offense in the third quarter and continued to struggle in the fourth. The Horned Frogs did manage the short scoring drive to set up Oberkrom's late field goal, but ended up going backward on their final drive after Conroy's kick.

"What I thought happened in the third quarter was Michigan State dialed up the heat and we didn't have an answer," Patterson said.

Michigan State did ? for one of the few times this season.

Nine killed, more than 20 hurt in Oregon bus crash

PORTLAND, Oregon (Reuters) - Nine people were killed and at least 20 others injured on Sunday when a charter bus headed to Canada from Las Vegas skidded off an icy highway and crashed down an embankment in northeastern Oregon.

The Oregon State Police said a preliminary investigation showed the charter bus, carrying about 40 people en route to Vancouver, British Columbia, "lost control on the snow/ice covered westbound lanes of Interstate 84" near Pendleton.

The bus crashed through a guardrail and went down an embankment of around 200 feet. People trained in rope rescue were needed to bring victims back up to the highway, police said.

State Police spokesman Lt. Gregg Hastings said nine people had been confirmed killed in the crash.

"We are continuing to try and confirm the total number of passengers and number of injured persons transported to area hospital or secondary locations due to severity of injuries." the state police said in a written statement.

The bus driver survived the crash but investigators had not yet been interviewed because of the severity of his injuries, police said.

St. Anthony Hospital in Pendleton received 18 of the injured, said Larry Blanc, the hospital's director of communications.

"About 10:30 this morning we got the call and declared a Code D, which means we bring in extra staff and supplies," he said, adding that D stands for "disaster."

"There are various types of injuries. Some of the injured were able to walk in on their own," Blanc said. "We are taking a lot of CT scans and assessing the injuries

Some of the injured were transported to nearby hospitals by ambulance and some were transported by air to other hospitals with trauma centers, he said.

Authorities did not immediately release the name of the charter company but said the bus was returning to Vancouver, British Columbia, as part of a round-trip to Las Vegas, Nevada.

Police said the names of the dead and wounded would not be released until next of kin were notified, which could take several days because many were believed to be from out of the country.

Pendleton is in northeast Oregon near the border with Washington state, about 200 miles east of Portland. (Reporting by Teresa Carson; Writing by Dan Whitcomb; Editing by Cynthia Osterman and Todd Eastham)

Police help family of 13 with home makeover | Stuff.co.nz

Police makeover

JAY BOREHAM / Fairfax NZ

ON THE JOB: Constables Merrin Dancy, Karen Ancell and Julia Williams paint a wall at the HNZ propery in Flat Bush.

Police have helped a South Auckland family of 13 avoid eviction by transforming their Housing New Zealand home, bringing it up to proper living standards.

The Flat Bush Neighbourhood Policing Team gained the support of the local community and businesses to upgrade the home, which was in such a poor state of repair the family was on its last chance with HNZ.

Constable Karen Ancell said 11 children lived at the house with their 32-year-old mother who was pregnant.

"We have stepped in to get the house up to scratch so the family can make a fresh start," Ancell said.

"They are struggling, to say the least, and some of the children are starting to come to police attention."

More than 40 volunteers helped with the make over while businesses donated materials and services.
?
The volunteers fumigated the house, repaired damaged walls and painted the interior.
Outside they tidied the grounds, erected raised garden beds and planted vegetables.

Police, Salvation Army and Habitat for Humanity representatives also donated furnishings to completely refurnish the house.

The community's input for a family they had never met was huge, Ancell added.
?
"It's about giving a family a fresh start. They are in a good place to change now, whereas in the past that hasn't been the case."

But giving them a home they can be proud of is just the first step. The police are also working to give the family the tools to become good members of society.

They will receive mentoring, budgeting advice, counselling and health checks as well as anger management and parenting training.

"They are in a bit of debt and it is very difficult to make headway out - it's a vicious circle."

Weight Loss Pill Qsymia 'Gaining Traction'

Dec. 26, 2012 -- Sales of the prescription weight loss drug Qsymia, the first such drug to get the FDA's OK in 13 years, are increasing, despite earlier reports of sluggish interest.

For the week ending Dec. 7, more than 2,000 new prescriptions for Qsymia were filled, according to Source Healthcare Analytics, a provider of pharmaceutical market data. That compares to 1,163 filled prescriptions for the week ending Nov. 23.

Depending on who you talk to, the drug, which went on sale in mid-September, is a godsend or a disaster.

Gwen Barton, 57, of New York, participated in a Qsymia clinical trial. She dropped 50 pounds in 18 months. She gained back half of that after the trial ended, then started back on the pill in early December.

The pounds came off again. "I have lost 12 pounds so far and I'm very happy,'' she says. She wants to shed another 40 pounds on her 5-foot-5-inch frame to get to 140 pounds.

Barton offered to share her story through the public relations firm for Vivus, the maker of Qsymia.

When the FDA approved the drug earlier in 2012, Sidney Wolfe, MD, director of Public Citizen's Health Research Group, called the decision ''reckless.''

His opinion hasn't changed, he says. "The history of diet drugs is a disaster," he says.

Qsymia Prescriptions Up

Michael Miller, chief commercial officer at Vivus, declined to release sales figures or quote prescription numbers until January, when fourth quarter results are in.

"We are pleased," he says of sales. "We have been gaining traction."

The drug is only sold through certified mail-order pharmacies whose personnel have finished a Qsymia-provided training program.

That was part of the risk reduction that Vivus agreed to with the FDA.

Average cost of the recommended dose is $160 for a one-month supply, Miller says.

Insurance coverage is not yet common. "About 1 out of 5 prescriptions are covered," he says. "The average co-pay is $50 or $60."

How It Works

Qsymia combines two drugs already on the market: phentermine and topiramate.

Phentermine is an appetite suppressant. (It was the ''phen'' part of the popular weight loss combination pill fen-phen. After reports of lung problems and heart valve damage surfaced, related to the ''fen'' or fenfluramine, the FDA requested fenfluramine's withdrawal from market in 1997).

Topiramate may work by suppressing appetite and helping you feel full, according to the drugmaker.

Qsymia is approved only for those who have a body mass index or BMI of 30+, termed obese, or a BMI of 27+, termed overweight, with another weight-related problem such as high blood pressure or high cholesterol.

It is prescribed with the understanding that patients will follow a healthy, reduced-calorie diet and get regular exercise.

Barton says she walks for exercise. She drinks a lot of water and has given up fatty foods, sodas, and another old favorite, doughnuts.

Thanksgiving was not the struggle it once was. "No seconds, no thirds, I didn't bring food home," she says.

Security Loophole In Facebook?s Camera App Allowed Hackers To Hijack Accounts Over WiFi [Confirmed]

Screen Shot 2012-12-24 at 10.55.10 AMPSA to all Facebook Camera users on iOS: If you haven’t update you app in the past few days, update?it now. The older version of the app, pre-1.1.2 and released before December 21, has a?security loophole. When used over WiFi networks, malicious hackers can tap the network and hijack Camera users’ accounts, picking up information like email addresses and passwords in the process. The white-hat hacker who ID’d the problem is Mohamed Ramadan, an Egypt-based security researcher and trainer with Attack-Secure?who has also found and reported vulnerabilities for Apple, Google, and Etsy — which apparently also had the same loophole in its iOS app. Ramadan tells us that the issue lied in the Camera app’s Secure Sockets Layer certification, which was too open. As he puts it, “The problem is the app accepts any SSL certification from any source, even evil SSL certifications and this enables any attacker to perform Man in The Middle Attack against anyone uses Facebook Camera App for IPhone. This means that the application doesn?t warn the user if someone in the same [WiFi network] trying to hijack his Facebook account.” Testing his theory by using a proxy to listen in on a WiFi network, he was able to type in his username and password into the Camera app, and then see that information appear via the proxy. Ramadan notes that he’s tested all Facebook apps and the rest appear to protect from this similar vulnerability. We’ve reached out to Facebook for comment but haven’t received a response. [Update: Facebook has confirmed Ramadan's bug discovery, which it addresses in the 1.1.2 version.]

Ga. counties sue HSBC claiming loss of tax base

ATLANTA (AP) ? Three Atlanta-area counties have filed a lawsuit claiming that British bank HSBC cost them hundreds of millions of dollars in extra expenses and damage to their tax bases by aggressively signing minorities to housing loans that were likely to fail.

The Georgia counties' failure or success with the relatively novel strategy could help determine whether other local governments try to hold big banks accountable for losses in tax revenue based on what they claim are discriminatory or predatory lending practices. Similar lawsuits resulted in settlements this year worth millions of dollars for communities in Maryland and Tennessee.

Fulton, DeKalb and Cobb counties say in their lawsuit, which was filed in October, that the housing foreclosure crisis was the "foreseeable and inevitable result" of big banks, such as HSBC and its American subsidiaries, aggressively pushing irresponsible loans or loans that were destined to fail. The counties say that crisis has caused them tremendous damage.

"It's not only the personal damage that was done to people in our communities," said DeKalb County Commissioner Jeff Rader. "That has a ripple effect on our tax digest and the demand for public services in these areas."

The city of Atlanta straddles Fulton and DeKalb counties, while Cobb County is northwest of the city.

The lawsuit says the banks violated the Fair Housing Act, which provides protections against housing or renting policies or practices, including lending, that discriminate on the basis race, color, national origin, religion, sex, family status or handicap.

The counties say their tax digests ? which represent the value of all property subject to tax ? have declined from a high point in 2009. Fulton's tax digest has dropped about 12 percent, from $32.7 billion to $28.7 billion; DeKalb's has dropped about 20 percent, from $22 billion to $17.5 billion; and Cobb's has dropped about 15 percent, from $25.5 billion to $21.3 billion, the lawsuit says. That reduces their ability to provide critical services in their communities, the lawsuit says.

In addition to reducing tax income, vacant or abandoned homes that are in or near foreclosure create additional costs for the counties, the lawsuit says. Their housing code and legal departments have to investigate and respond to code violations, including having to board up, tear down or repair unsafe homes. They have to deal with public health concerns, such as pest infestations, ruptured water pipes, accumulated garbage and unkempt yards. And fire and police departments have to respond to health and safety threats.

The lawsuit says predatory lending practices include: targeting vulnerable borrowers for mortgage loans with unfavorable terms; directing credit-worthy borrowers to more costly loans; putting unreasonable terms, excessive fees or pre-payment penalties into mortgage loans; basing loan values on inflated or fraudulent appraisals; and refinancing a loan without benefit to the borrower.

The counties are asking the court to order the bank to stop its behavior and to take steps to prevent similar predatory lending in the future. They are also seeking financial compensation for the damages they've suffered and punitive damages to punish the bank for its "willful, wanton and reckless conduct." The counties say the financial injury they've suffered is in the hundreds of millions of dollars.

Andrew Sandler, a lawyer for HSBC and its subsidiaries, said he couldn't comment on the case. A federal judge has given the bank until Jan. 25 to respond to the counties' complaint.

Lawyers for the counties declined interviews on the case, but one of them, Jeffrey Harris, said in an emailed statement that they are continuing to investigate other banks and could file additional complaints.

Similar suits were filed against Wells Fargo by the city of Memphis and surrounding Shelby County in Tennessee in 2009 and by the city of Baltimore in 2008. Those suits were settled earlier this year. Both settlements included $3 million to the local governments for economic development or housing programs and $4.5 million in down payment assistance to homeowners, as well as a lending goal of $425 million for residents over the subsequent five years, according to media accounts.

As in those cases, the lawsuit filed by the Georgia counties says the bank, in this case HSBC, targeted communities with high percentages of Fair Housing Act-protected minority residents, particularly blacks and Hispanics.

"Communities with high concentrations of such potential borrowers, and the potential borrowers themselves, were targeted because of the traditional lack of access to competitive credit choices in these communities and the resulting willingness of FHA protected minority borrowers to accept credit on uncompetitive rates," the lawsuit says.

The lawsuit says minority borrowers were disproportionately targeted with high-cost loans between 2004 and 2007.

Before the beginning of the subprime lending boom in 2003, annual foreclosure rates in metro Atlanta averaged below 1 percent, but U.S. Department of Housing and Urban Development data show that the estimated foreclosure rates for each of the three counties now average more than 9 percent and are as high as 18 percent in the communities with the highest percentages of minority borrowers, the lawsuit says.

It is the alleged targeting of minority communities that entitles the counties to seek action against HSBC for loss of tax income and other expenses, the lawsuit says.

"If you can show that you yourself have suffered harm by an illegal act under the Fair Housing Act, even if you are not the target, even if you are not the intended victim, you can still sue to stop the behavior and to recover any damages that you can prove you suffered because of the violation of the Fair Housing Act," said Steve Dane, a lawyer whose firm was involved in the Memphis and Baltimore lawsuits.

The costs incurred by counties because of high rates of foreclosure are reflected in court records and related fees for each home, and police and fire departments can calculate the costs of responding to a given address, Dane said. He said it takes a lot of time and effort to gather the necessary records to prove the harm.

Another discouraging factor could be a lack of political will, said Lisa Rice, vice president of the National Fair Housing Alliance.

"Politicians may not want to go up against the banks," she said, adding that there will likely be other local governments that give this a try but she doubts the number will be high.

But Jaime Dodge, an assistant law professor at the University of Georgia, says she thinks more cases are likely, at least in the short term as municipal governments continue to feel the squeeze of a tight economy and seek ways to refill their coffers. They may try to test federal courts in different parts of the country, she said. Successes in multiple jurisdictions could lead to more attempts, but if courts start knocking the suits down that would likely discourage them, she said.

Controversial Christmas light display upsets neighbors in La ...

Posted on: 12:02 pm, December 24, 2012, by Joe Borlik, updated on: 12:07pm, December 24, 2012

DENHAM SPRINGS, La. ? Residents in a small Louisiana town say they are upset about one homeowner?s Christmas lights display which features a giant middle finger.

WAFB reported that police originally told Sarah Childs to take down her outdoor Christmas lights display on Starlite Drive in Denham Springs after receiving complaints from neighbors.

One neighbor told WAFB that she could not believe someone would install such a display using Christmas lights.

However, Childs was awarded a temporary restraining order against the city ? and reinstalled the lights.

?We will show up if there?s a serious need, emergency, fire or requiring police protection or whatever ? but not to oppose this judge?s orders no way shape or form,? said Denham Springs Mayor Jimmy Durbin.

Childs filed suit against Denham Springs with help from the American Civil Liberties Union.

According to executive director Marjorie Esman, what some call offensive is Childs? guaranteed right to Freedom of Expression.

?If people find it distasteful or they don?t like it, well, that?s life,? Esman said. ?We all are exposed to things we don?t like, and people have different opinions. That?s what makes for a free society.?

The temporary restraining order gives Childs the right to use these lights to express herself at least until that January hearing.

However, neighbors said they have no problem with Childs? free speech?claim,?but worry about the display?s effect on little ones.

?Kids are going to look at those lights and wonder? what does that mean?? Todd Traylor, one of Childs? neighbors, said. ?How do you explain to a 4-year-old kid or a 2-year-old kid that doesn?t know what that means yet, and you try to shield them from stuff like that.??

New Interstate 17 'flyover' bridge opens to traffic, to improve traffic flow

logo_azdotPrescott AZ (December 22, 2012) ? Just in time for the Christmas and New Year?s holidays, the Arizona Department of Transportation has completed the new Cordes Junction ?flyover? bridge, which opened to traffic Thursday night. The overpass will lift northbound traffic headed to the Prescott area over Interstate 17 and connect directly to northbound State Route 69.

About an hour?s drive north of downtown Phoenix, ADOT is remaking the I-17/SR 69 traffic interchange (milepost 262). When completed, the updated, modern interchange will make it easier for drivers to connect to other northern communities including Prescott, while improving traffic flow and safety.

A major component of the $50 million project was the completion of the new flyover bridge. Due to the outdated design of the previous interchange, slower local traffic destined for the businesses and residences in the Cordes Lakes area, were forced to mix with the high speed traffic at this busy interchange, which serves more than 40,000 vehicles per day.

20121222_Cordes-Junction-Flyover-Bridge

?Completing the new flyover bridge is a major milestone on this Cordes Junction traffic interchange reconstruction project,? said Prescott District Engineer Alvin Stump. ?The interchange was built almost 50 years ago when traffic volumes were much lower and it mixes local and through traffic, resulting in congestion and delays. This updated interchange will not only be able to handle the future growth in this area, but also make it safer for all drivers.?

After beginning construction in August 2011, ADOT is entering the final stages after having completed more than 80 percent of the project. ADOT is on target to complete the project as scheduled by June 2013. The remaining major work yet to be completed includes opening the new southbound Big Bug Creek Bridge and east roundabout near the McDonald?s restaurant, and repaving I-17 and SR 69.

Improvements to the interchange will increase accessibility to local businesses, provide more efficient traffic movements for those traveling through the area, and prepare for future traffic demands. The project includes seven new bridges, three local roads (Copper Star Road, Arcosanti Road, Stagecoach Trail), installation of two roundabouts, as well as improvements to local stormwater drainage.

Since the start of the project, ADOT has worked closely with the community during construction to ensure that impacts to residents and businesses are minimized. Local businesses have remained open during the construction, including the local McDonald?s restaurant on Cordes Lakes Road, which is adjacent to the I-17/SR 69 interchange.

?ADOT has worked with the local businesses and the community to make sure drivers have access at all times despite the construction,? said Eric Coleman, McDonald?s district supervisor for northern Arizona. ?While no one ever wants to have to deal with construction impacts, this project will improve safety and provide better access to some of the local businesses and residences in the area for many years to come.?

For more information on the project, including photos and video, please visit the ADOT Blog.

Genetic defect causing fragile X-related disorders more common than thought

Friday, December 21, 2012

A single genetic defect on the X chromosome that can result in a wide array of conditions ? from learning and emotional difficulties to primary ovarian insufficiency in women and tremors in middle-aged men ? occurs at a much greater frequency than previously thought, research led by the UC Davis MIND Institute has found.

The research is based on the first large-scale, multi-center newborn screening effort for the defect in the United States, conducted in a group of more than 14,200 male and female infants at three research university medical centers piloting a new infant screening test developed at UC Davis.

The study, "FMR1 CGG Allele Size and Prevalence Ascertained Through Newborn Screening in the United States," was led by Flora Tassone, professor-in-residence in the Department of Biochemistry and Molecular Medicine, and was conducted using blood spots obtained from infant heel pricks as part of the normal newborn genetic screening process. It is published online today in the journal Genome Medicine.

The investigators examined the prevalence of expanded alleles of the fragile X mental retardation 1 (FMR1) gene. Defects in FMR1 cause conditions as diverse as fragile X syndrome ? the leading cause of intellectual disability and the leading known single-gene cause of autism ? and a Parkinson's disease-like condition called fragile X-associated tremor/ataxia syndrome, or FXTAS. The term "fragile X" is used because of the altered appearance of the X chromosome among sufferers from the conditions.

"This study demonstrates that there is a higher frequency of mutations of the FMR1 gene across racial and ethnic groups than previously believed," said Randi Hagerman, medical director of the UC Davis MIND Institute and one of the world's leading experts on fragile X-related conditions. "It also demonstrates that newborn screening for fragile X mutations is technically feasible in a large-scale setting using the blood spot technique developed by Dr. Tassone."

The degree of disability from defects in FMR1 depends upon the number of repetitions of the sequence of the proteins cytosine-guanine-guanine (CGG) in the promoter region of the gene. The range of repeats in normal individuals is between six and 40. CGG repeats greater than 200 cause what is called the full mutation and fragile X syndrome. Fewer repeats ? in the range of 55 to 200 ? result in a variation called a premutation.

The current study found the estimated prevalence of the premutation to be 1 in 200 females, a finding somewhat greater than earlier estimates. However, it estimates the prevalence among males to be 1 in 400 ? double what had previously been reported. The researchers said that the sample size in the current study was not great enough to estimate the true prevalence of the full fragile X mutation, currently estimated at between 1 in 2,500 and 1 in 8,000 females and 1 in 5,000 males.

While most people with the premutation appear normal, some individuals can have mild difficulties in childhood, such as such as learning problems or emotional difficulties including social anxiety and attention deficit hyperactivity disorder (ADHD), said Hagerman, a professor in the Department of Pediatrics. Individuals with the premutation also can suffer from FXTAS, which causes debilitating tremors, balance problems and dementia primarily in older men, and premature ovarian insufficiency in women.

Tassone, a researcher affiliated with the MIND Institute, is one of the world's leading experts on screening and identification of the FMR1 mutation. Her polymerase chain reaction (PCR)-based test used in the current study was described in January 2008 in the Journal of Molecular Diagnostics.

"This study shows that newborn screening for the FMR1 mutation is technically possible on a large scale," Tassone said. "However, the screening will identify far more carrier and gray-zone infants than those with a full fragile X mutation. As we now know that there may be clinical involvement with these individuals, such as FXTAS, we need to better understand the impact of identifying these mutations on families before widespread newborn screening can be instituted."

Hagerman said that the study is important because early intervention can be helpful for children with these mutations who experience developmental problems. In addition, a baby who is positive for the mutation will have other family members who also carry mutations. Genetic counseling is essential for the family members, in addition to treatment for the medical or psychiatric problems associated with the premutation or full mutation, she said.

NuVo P200 Wireless Player

NuVo's new Wireless Audio System delivers streaming audio anywhere in your home?even to multiple rooms simultaneously. The P200 ($599 list), the company's wireless stereo amplifier and media hub, supports dual-band 2.4GHz and 5GHz Wi-Fi and MIMO for truly reliable performance, and is capable of transmitting up to 16 simultaneous streams at 600Kbps each. It's also a stereo amplifier, giving you the ability to hook up any pair of passive speakers that could very well sound much better than any AirPlay or Bluetooth speaker.

Used as intended?in multiple rooms, with?the GW100 Gateway (which is required for wireless use),?multiple P200s, and multiple sets of speakers?the whole system is very expensive for the average music listener, and it has a few issues as well. But if you're an audio component fan interested in top-quality wireless streaming throughout your home, and you have the means, read on.

Design, Amplifier, and Main Setup
The NuVo P200 measures 1.65 by 9.02 by 5.0 inches (HWD) and weighs 2.5 pounds. It's made entirely of black plastic, with a vertically curved edge on one side and a horizontally curved edge on the other. The front panel is clean save for four capacitive buttons, which control volume, muting, and Bluetooth functions, plus a combination power and status LED. The back panel houses standard-size 3.5mm input and output jacks, a 3.5mm setup mic port that the manual says is for "future use" only, and four gold 5-way binding posts for connecting speakers. There are also USB 2.0 and Ethernet ports, plus a hardware power switch that, thankfully, doesn't send a loud thump through your speakers when you switch it on.

Inside is a 60-watt-per-channel stereo amplifier that works with 8 ohm and 4 ohm passive speakers. There's Audyssey-powered dynamic volume processing onboard for balancing day and night listening at lower levels, as well as bass and treble adjustments with 12 dB of range in either direction. I tested the P200 with a pair of Klipsch HD Theater 600 satellites and their companion 100-watt, 8-inch powered subwoofer. I hooked up the satellites to the P200 via its five-way binding posts, and then used a 6-foot stereo Y-cable (which is not included) to connect the stereo 3.5mm mini-jack line out on the P200 to the pair of stereo RCA inputs on the powered subwoofer.

The setup process is a little confusing. First, you hook up your speakers, plug the P200 into the wall, download the NuVo Player iOS or Android app on your mobile device, and follow the on-screen instructions. From the app, you can begin setup of a new system or join an existing system you're expanding.

Unfortunately, while the P200 supports Wi-Fi, you need the $199 NuVo GW100 Gateway in order to use the P200 wirelessly. Otherwise, you must use the included Ethernet port and connect it to your router. I tested the P200 with the GW100, which came with no instructions. Basically, you just connect the main port (not one of the four LAN ports) to an existing free port on your router with the included Ethernet cable. The app found it immediately. Next, I powered on the P200, waited for the solid green LED light indicating ready status, and then tapped Next in the app. Then I paired the P200 with the GW100 by holding down the Volume Up and Mute buttons as indicated. From there, I was off and running.

Sound Quality and Music Source Setup
As a general rule, sound quality from the built-in amplifier was uniformly excellent, with a clear soundstage and plenty of gain. I wouldn't have any reservations about powering a full-range pair of floorstanding speakers with the P200. That said, audiophiles may wish to bypass the P200's internal amp and employ the line out for use with an external integrated amplifier or preamp/amp combo. Even better, I didn't experience any audio dropouts while sharing music from a variety of sources, even on our extremely saturated PCMag Labs Wi-Fi networks.NuVo P200 Back

The real purpose of the NuVo system is to enable multi-room wireless streaming, and with multiple sources of music. For that, you may find that a single P200 isn't enough; you can put one in each room, along with an appropriately sized set of speakers, and then control the whole shebang using the app's visual interface. This is the kind of setup where the NuVo system excels, thanks to its reliable wireless performance.

High or dry? Staying sober for New Year's Eve

NEW YORK (AP) ? Jennifer Perry isn't much of a drinker. Never has been, yet she's ready every New Year's Eve for the inevitable attention when she's out trying to have a good time.

"I don't care if everyone at the table orders a drink but me. That's fine," said Perry, 46, a singer in Atlanta. "What I do resent is being pressured, and then being asked is it a 'religious thing' or if I have a 'problem.'"

Sometimes, she relies on: "Oh, thank you, but I'm still on methadone." While not true, a quick apology usually ensues and the pesky prober moves along.

Whether in recovery or not interested for other reasons, the holidays often mean an excess of booze and drugs. Occasional drinkers fail to moderate and addiction programs around the country note upticks in patient loads soon after the new year, high season for relapsers and those seeking treatment for the first time.

"Alcohol is often center stage at holiday parties," said Amara Durham, a spokeswoman for Caron Texas, a treatment facility in Princeton, Texas. "Many people think they need alcohol to enjoy social occasions such as holiday celebrations."

Chapman Sledge, chief medical officer at Cumberland Heights, a center in the Nashville, Tenn., area, said loved ones hosting holiday dinners and parties should be sensitive to the difficulties of recovering guests.

"Stray comments like, 'Just a sip of wine at dinner won't hurt,' or 'It's a party, have a little fun,' even if they're unintentional, can slow or destroy an addict's recovery," he said.

Gina Bestenlehner, who is 12 years sober and program director for the Pur Detox center in Dana Point, Calif., suggests bringing along a sobriety buddy to help stay focused. She also recommends volunteering as a designated driver, which "gives a person new purpose and a reason to be there sober. It also saves lives."

Like other support groups around the country, the North Central Vermont Recovery Center in Morrisville hosts a sober New Year's Eve.

"Along with Thanksgiving and Christmas, New Year's Eve is one of those holidays that we try to create community events for because of their association with drinking and the stress of being in recovery and alone on them," said Nasreen Stump, a fundraiser for the center. "In three years our attendance at these events has almost quadrupled."

In Jersey Shore, Pa., Mary Baier is a non-drinker who will likely stay home with her husband this year for New Year's Eve. In the past, they've left parties right after midnight. "It's kind of hard to have a good time once people get drunk," she said.

Cathy Griffin, 54, of Los Angeles has been sober for five years. "I'm a free woman now and go about my business and personal life wherever there is alcohol and barely give it any thought," she said, "but in the early days of my recovery, it was hell!"

Instead of salivating while watching the wine meet the lips of the guy across the room, offer to help cut fruit and veggies or rinse some glasses, " anything to get your mind off the fact that you can't drink," she said.

"Look for people who are not drinking to start up a conversation. Believe it or not, there are more people who are not sloshed than you might think," Griffin added. "Make a game or a challenge out of finding the folks who are not drinking."

And perhaps most important of all, she said, "Prepare before the battle." Think about what you're going to drink before you get there. Stay away from caffeine-laden energy drinks and go straight to the bar and ask for a non-alcoholic beverage with a smile.

"I found for me, I didn't have to stay all night," Griffin said. "If I felt uncomfortable, even if it wasn't already midnight, I gave myself permission to leave or go outside and call a sober buddy, and most importantly, breathe ? the moment will pass."
